creators and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) and similar laws.
This page explains how to submit a copyright takedown notice and how we respond.
1.Designated copyright agent
Our designated agent to receive copyright infringement notices under 17 U.S.C. § 512(c)(2) is:
DMCA Agent
Phoenix Consulting Group, LLC
1500 N Grant St Ste R
Denver, CO 80203
United States
Email:
[email protected]
Agent registration status: Phoenix Consulting Group, LLC has filed (or is in the
process of filing) a single Designated Agent registration with the U.S. Copyright Office covering both
musenest.net and musenestclub.com. While this filing is pending, the agent
contact above remains the correct address for service of DMCA notices for content on MuseNest Club.
Email is the fastest way to reach us. For time-sensitive matters such as non-consensual intimate
imagery, use the same address with subject "URGENT — NCII".
2.What to include in a takedown notice
To submit a valid DMCA takedown notice, your written notice must include all of the following (17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work you claim has been infringed. If multiple works are covered by one notice, a representative list is acceptable.
- Identification of the infringing material — provide the URL(s) of the specific content on MuseNest Club that you claim infringes your work.
- Your contact information: name, address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
False notices carry legal consequences. Submitting a knowingly false DMCA notice may
expose you to liability for damages under 17 U.S.C. § 512(f), including attorney's fees. Only submit a
notice if you have a genuine good-faith belief that infringement has occurred.
3.Our response to notices
Upon receipt of a valid DMCA notice we will:
- Promptly disable access to or remove the allegedly infringing content.
- Notify the creator (the uploader) that their content has been removed due to a copyright claim, and provide them a copy of the notice (with your contact information redacted if you request it).
- Log the notice as part of our repeat-infringer tracking process.
We aim to acknowledge notices within one business day and complete takedowns within two business days of a valid notice.
4.Counter-notices (creator dispute process)
If you are a MuseNest Club creator and you believe your content was removed in error or misidentification, you may submit a counter-notice. A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the removed content and its location before removal (URL or description).
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and consent to jurisdiction in the federal court for your district (or, if outside the US, for any judicial district in which MuseNest Club may be found).
- A statement that you consent to service of process from the complaining party or their agent.
Send counter-notices to [email protected]
with the subject line "DMCA Counter-Notice." If we receive a valid counter-notice, we will forward it
to the original complainant. If the complainant does not notify us within 10–14 business days that
they have filed a court action, we may restore the content at our discretion.
5.Repeat infringer policy
MuseNest Club has a policy of terminating the accounts of users who are repeat copyright infringers in
appropriate circumstances, consistent with 17 U.S.C. § 512(i)(1)(A). A creator whose content is the
subject of three or more valid DMCA notices within a 12-month period is subject to permanent account
suspension.
6.Non-consensual intimate imagery (NCII)
If you appear in content on MuseNest Club without your consent, you do not need to send a formal DMCA notice — contact us directly:
- Email: [email protected]
- Subject: NCII Removal Request
- Include: a description of the content, the URL if known, and confirmation that you are the person depicted
We treat NCII reports as the highest priority and will act within one business day. We also cooperate
with law enforcement and maintain relationships with organizations that assist NCII victims.
7.Reporting from inside the platform
If you are subscribed to a creator and you see a piece of content that you believe violates this
policy, every post in your feed has an in-product Report button. Reports go directly
to our compliance queue and are reviewed by our team. The in-product flow is the fastest path for
content already gated to your account.
